INFORMATION PRIOR TO CONTRACTING

This web site https://www.ceuiam.com is owned by FUNDACIÓN UNIVERSITARIA SAN PABLO CEU, holder of Tax Identification Code (CIF) G28423275 and with registered address located at C/ ISAAC PERAL Nº 58 28040 MADRID, SPAIN, doing business under the brand CEU Institute for Advanced Management (CEU IAM Business School), hereinafter CEU IAM.

The herein General Contract Conditions govern the distance selling transaction between CEU IAM and the User or Consumer, as provided for by applicable legal provisions, particularly by Act 7/1998, of 13 April, on General Contract Conditions, Act 3/2014, of 27 March, amending revised General Act for the Defense of Consumers and Users, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Protection of Natural Persons with regard to the Processing of Personal Data and on the Free Movement of such Data, and repealing Directive 95/46/EC (General Data Protection Regulation), Act 7/1996, of 15 January, Ruling Retail Commerce, and Act 34/2002, of 11 July, on Services of Information Society and of Electronic Commerce.

CEU IAM reserves the right to make any amendment it thinks fit, with no prior notice, to these General Conditions. Any such amendments can be made, on its websites, by any way legally possible and any such amendments shall be binding for the whole term they are published on the website and until they are validly amended by subsequent amendments. Notwithstanding the above, CEU IAM does hereby reserve the right to apply, in some cases, Particular Contract Conditions instead of these General Conditions, whenever it deems it fit, publishing them in good time and properly.

The object of this web site is the promotion and sale of the training offer of Institute for Advanced Management. Term of the agreement shall be bound to the length of the enrolled training offer.
All contents in the web site are in Spanish.

As Consumer-User you do hereby expressly declare that you are aware, you understand and you accept use conditions and these General Contract Conditions. Likewise, you declare that you have reached the age of majority and that you have the legal and acting capacity necessary to have access to CEU IAM website and particularly to contract on-line.

ENROLMENT PROCEDURE

To hire any of our training products, you might address to the section “Training Offer”, where you can get further information on the chosen training product and you can include the product so chosen to the shopping cart.
When getting to our section “Training Offer” you shall be able to choose among the following options:

You do not need to register as User of the website to carry out the on-line purchase, but you shall need to fill in the data collection form in order to hire the products. You can read our policy on data protection here.

Once the purchase procedure has been ended, Consumer-User shall receive a confirmation of the purchase order by email. It is essential that User provides a valid email address within the purchase procedure. Should you not receive such confirmation within 24 hours from end of your order, please contact CEU IAM by calling our customer service telephone at +34 91 514 05 73, or by email to [email protected] or by means of the Contact form.

Consumer-User shall receive an invoice or copy of the purchase order, as evidence of acceptance of the hiring of the training service.

OFFER AND VALIDITY TERM

Should there be any service at a promotional price, the offer shall state together with its essential conditions, the price of the offer and its term of validity.

In compliance with applicable law, CEU IAM offers information on all of the available training products, their features and their prices. Notwithstanding, CEU IAM reserves the right to withdraw or to change the products offered in its website, by merely changing the contents of the website. Thus, products offered from time to time on the web shall be governed by the General Contract Conditions applicable in each case. Likewise, CEU IAM shall be entitled to stop offering, any time and with no need of prior notice, access to any item.

ESSENTIAL FEATURES OF PRODUCTS

Products offered in our online shop include a photograph and its essential features, as well as a description of its contents.

Products include a description to be considered as the basic features of the hired training product.

All services offered in the website benefit from the guarantee applicable to the kind of service and to the time and way of rendering of the services asked for.

PRICES

All products show the price of sale in Euros and include Value Added Tax (TVA). Should any other tax be applicable, we shall state it so.

DELIVERY AND FREIGHT EXPENSES

CEU IAM makes deliveries only to Spain and France, by ordinary post, with no charge for shipping costs.

WAYS OF PAYMENT AND ORDER FULFILMENT

Consumer-User can pay the amount of any order through any of the following ways. Consumer-User shall have to indicate his/her choice:

All transactions entailing personal or bank data transmission are carried out in a safe environment, a server based on security technology standards SSL (Secure Sockets Layer). Any information provided by you shall be transmitted in the net through an encrypted connection. Likewise data on your credit card are directly inserted in the web of the bank, at the POS (Terminal Point of Sale of Bank) and are not inserted or registered in any of CEU’s server.

When paying with VISA or MASTERCARD cards the following information shall be asked to you: card number, end of validity date, and a Validation Code which is the last three figures of the number to be found written in italics on the back of your VISA or MASTERCARD card, offering, this way, more guarantees concerning the transaction. This way of payment is only possible in the website.

When the amount of a purchase has been illegally or unduly charged, using the number of a payment card, the holder of the card shall be entitled to demand immediate cancellation of the charge. In this case, the corresponding debit and refund entries in the accounts of supplier and of holder shall be carried out as soon as possible.

Notwithstanding the foregoing, if the purchase has been effectively made by the holder of the card and the demand for refund does not come from the right of withdrawal or of termination, and thus, cancellation of the charge has been unduly requested, holder shall be subject to compensate CEU IAM for any damages arising from any such cancellation.

When choosing bank transfer, User shall receive a confirmation by email with CEU IAM bank details.

When ordering the transfer, it is very important to state as subject matter the number of reference and your name and surnames, and to carry out the transfer within 3 days after the date of confirmation, so that we can validate it.

Should you wish to do so, you can send us the bank transfer document by email to [email protected]. In any case, the service shall not be effectively validated until our operation support department gets bank confirmation of the transfer.

Please keep in mind that payment is to be made in EUROS and that any money exchange and bank commissions are to be met by you.

In the case of bank transfers ordered from outside of Spain, it is very important when ordering the transfer to instruct your bank that any commissions at origin, bank commissions and expenses corresponding to your entity are to be met by you. Should it not be so, CEU IAM could paralyse the hired service for lack of full payment of the service.

Any applicable money Exchange or bank commission is to be met by client.

If you are already our client and it is not the first time that you hire our services, you can choose this way of payment and CEU IAM shall debit payment to the bank account detailed by you to this purpose.

CEU IAM does hereby undertake to start the training service on the hired training service starting dates published in the description of the hired training service.

Availability of services offered by CEU IAM can change depending on the service. Should the service not be rendered due to unavailability, CEU IAM shall inform client on unavailability of the service to be rendered by email as soon as it becomes aware of such unavailability. Any such notice shall have to be given within 30 days, and CEU IAM shall be entitled to give the double option to: offer client, for no additional price, a service of similar or greater features, or within that same term,  unless there are grounded and provable reasons not to do so, to refund any amount paid for the cancelled service. Should CEU IAM not make the refund within that term, purchaser shall be entitled to claim payment of an amount equal to double of the amount to be refunded, regardless purchaser’s right to damages.

CANCELLATION OF ORDER AND RIGHT OF WITHDRAWAL, RETURN AND REFUND OF PAYMENT.

Cancellation of order and right of withdrawal.

Consumer-User shall be entitled to exercise the legal right of withdrawal concerning the condition of “enrolled” within fourteen calendar days following the date of payment of enrolment, with no need to give any reason for withdrawal and with no penalty of any kind; in this case, Consumer-User shall be refunded in full the amount paid for enrolment. The right of withdrawal can be validly exercised by written notice sent by Consumer-User to CEU Institute for Advanced Management, at Calle Tutor, 35, 28008 Madrid (Spain), stating his/her name and surnames and the degree or qualification for which he/she had enrolled. The exercise of this right shall entail loss of the enrolment rights.

14 calendar days after enrolment, no refund shall be carried out.

Pursuant to section 103 of Act 3/2014, of 27 March, amending revised General Act for the Defense of Consumers and Users, supplies of services or goods manufactured according to consumer’s specifications or clearly customized, or those which taking into account their nature cannot be returned or might get quickly damaged or expire, shall not be subject to withdrawal.

Validity of enrolment is subject to:

  1. Submission with CEU IAM Secretary’s office of all documents required to be admitted as student of the degree or qualification object of enrolment.
  2. Full payment of fees determined by the Centre and veracity of all data and documents submitted by student.

Enrolment includes any academic right such as request for marks, certificates, transfer of record, getting degree or qualification, etc. In order to benefit from those rights, student shall have to be uptodate with payment in full of academic fees.

Once enrolment has been executed, there shall be no right to cancel it but for the right of withdrawal provided for here above. Notwithstanding, once teaching has started, student can leave the Program any time by giving written notice to this purpose to the Management of CEU IAM Business School. Such withdrawal shall be effective from the month following the month on which written notice of withdrawal has been given, with due fulfillment of the obligation to pay any outstanding fees where payment by instalments has been requested. In any case the academic record shall be kept to any applicable legal purpose, in view of future enrolments with CEU IAM or to the purposes of transfer of record.

Academic fees correspond only and exclusively to the rendering of the teaching service for the degree or qualification object of enrolment, this being the only services to be rendered corresponding to payment of those fees.

When enrolling, student consents and accepts that teaching, tutorial, internships and tests of assessment might be either in-person or distance (when the competent authorities so require it, directly or indirectly).

The obligation to fully pay the academic fees shall survive even where any teaching activity object of the degree/qualification cannot be carried out according to the teaching planning provided for at the beginning of the academic year, for any reason beyond CEU IAM’s control. Should this happen, CEU IAM shall guarantee student that any such activity shall be rescheduled as soon as possible, taking into account the interest of students and any other applicable academic criteria.

CEU IAM does hereby reserve the right not to teach the program for justified reasons; in this case, CEU IAM shall give at least seven days’ notice and shall refund any paid amount.

ATTENDANCE TO 85% OF CLASSES AND PASSING THE END OF PROGRAM PROJECT, when included in the syllabus, SHALL BE NECESSARY to achieve THE PROGRAM. Student has the right to no more than two enrolments, which include, each of them, an ordinary and an extraordinary call, in each course part and/or subject that make up the studies. The grade “not shown up” in the grading certificate of a subject consumes that call. Should student use all enrolments and their corresponding calls without passing the course part and/or subject, student shall have to abandon the studies.

Refund of payment

Refund of amounts paid  by Consumer-User shall be made in the same way as payment was made by Consumer-User, unless otherwise provided.

CEU IAM shall be entitled to withhold refund until reception of the product concerned by withdrawal, or until Consumer-User provides an evidence of its return, whatever happens first.

Should CEU unfairly delay refund of any paid amount, Consumer-User shall be entitled to claim the double of the amount paid, without prejudice to the right to be compensated for any damages exceeding such double amount.

CLAIMS

Should Consumer-User wish to make any claim, CEU IAM seat is located at C/ Tutor, 35 Madrid, Spain, or you can address to the email address [email protected].

JURISDICTION

Likewise, CEU IAM does hereby reserve the right to file any civil or criminal suit that it deems fit for wrongful use of its website or for breach of the herein conditions.

The relation between User and Provider shall be governed by applicable law in Spain. Should there be any dispute, the parties may submit their conflicts to arbitration or to the ordinary jurisdiction complying with applicable legal provisions concerning jurisdiction and authority. The registered office of CEU IAM is in Madrid, Spain.
